1.1The website www.techontap.com.au (the ‘Website’) is operated by Technology on Tap Pty Ltd (ABN 40 136 087 299) (‘we’, ‘us’ or ‘our’). These terms and conditions (the ‘Terms’) apply to your use of the Website, to the products we supply (the ‘Products’) and to the service, maintenance, installation, programming and project work we carry out (the ‘Services’).
1.2By using the Website, requesting a service visit, accepting a quote or purchasing Products, you agree to these Terms. If a written quote or contract we give you is inconsistent with these Terms, the quote or contract applies to the extent of the inconsistency.
1.3We may update these Terms from time to time by publishing a new version on this page. Changes apply to Services requested and Products ordered after the date the new version is published.
1.4Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
2.1Our current service rates, minimum charges, travel charges and billing increments are published on our Service & Maintenance page. They apply to service and maintenance visits unless we have given you a written quote.
2.2Parts, equipment and materials are charged in addition to labour unless they are included in a written quote.
2.3Where a fault cannot be resolved during a visit because additional parts, equipment or another trade (for example, an electrician) is required, the visit will be charged as a diagnostic visit. The additional works will be quoted and charged separately.
3.1Quotes are based on the information available to us at the time and are valid for the period stated on the quote.
3.2Any change to the scope of work requested by you, or required because of site conditions that were not reasonably apparent when we quoted, is a variation. We will tell you before carrying out a variation, and variations are charged at our applicable rates or as separately quoted.
4.1You must provide safe and timely access to the site and to the relevant equipment, and tell us about any known hazards at the site.
4.2If we attend at the agreed time and cannot access the site or carry out the work for reasons outside our control, the visit may be charged at the applicable minimum charge.
4.3Please give us as much notice as possible if you need to cancel or reschedule a booking. If our technician has already departed for the site, travel time may be charged.
4.4We may decline or stop work where we consider the site or the work to be unsafe.
5.1We service and maintain systems that we did not originally install. We are not responsible for pre-existing faults or defects, or for the condition of equipment, wiring, programming or documentation supplied or installed by others. Work required to investigate or rectify these is chargeable.
5.2Where a current project file, programming backup, password or site documentation is not available, the additional time required to recover or recreate it is chargeable.
6.1Service visits are payable on completion of the works. Installation and project work is payable as set out in the quote or progress invoices. All other invoices are payable by the due date shown on the invoice.
6.2Payment may be made using the methods shown on our Service & Maintenance page or on your invoice. Online payments are processed by third-party payment providers, whose own terms and policies also apply.
6.3If an invoice is not paid by its due date, we may suspend further work until the account is paid, and you must pay any reasonable costs we incur in recovering the overdue amount.
6.4Products remain our property until they have been paid for in full. Risk in the Products passes to you on delivery or installation.
7.1Product prices are in Australian dollars and include GST unless stated otherwise.
7.2We may, at our discretion, accept the return of a Product for a change of mind within 7 days of supply, where the packaging is unopened and the Product remains in a saleable condition. You are responsible for any postage and shipping costs for change-of-mind returns.
7.3If a Product is faulty, you are entitled to a repair, replacement or refund in accordance with the Australian Consumer Law and clause 8 (Warranty). Change-of-mind conditions do not apply to faulty Products.
8.1Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this warranty limits or excludes any rights or remedies available under that law.
8.2Subject to the terms of this warranty, a product fault reported within six (6) months from the date of supply or installation will be covered for both replacement parts and the reasonable labour required to repair or replace the faulty product.
8.3After the initial six (6) month period, and for the remainder of the applicable manufacturer’s warranty period, the warranty will cover the repair or replacement of the faulty product or part only. Unless otherwise required by law, any labour, service call, travel, diagnosis, removal, reinstallation, programming, recommissioning, postage or freight costs will be chargeable to the customer.
8.4Programming and workmanship performed by Technology on Tap Pty Ltd are warranted for twelve (12) months from the date the relevant work was completed. If a fault is determined to have resulted directly from our programming or workmanship and is reported within this period, we will rectify that fault at no charge for parts or labour.
8.5This warranty does not cover faults or damage caused by misuse, accidental or physical damage, unauthorised alterations, third-party work, incorrect operation, external systems, power disturbances, environmental conditions, normal wear and tear, or circumstances outside the reasonable control of Technology on Tap Pty Ltd.
8.6Warranty coverage is subject to assessment and confirmation of the cause of the fault. If an inspection determines that the fault is not covered by this warranty, the customer may be charged for attendance, diagnosis, labour, travel and any parts supplied.
8.7This warranty does not cover the cosmetic appearance of Products, or Products whose exterior has been damaged or defaced, or which have been altered or modified in design or construction.

Unless otherwise indicated, all rights in the Content are owned or controlled by Technology on Tap Pty Ltd or its contributors.
10.2Nothing you do on or in relation to the Website transfers to you:
(a)the business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright of Technology on Tap Pty Ltd;
(b)the right to use or exploit a business name, trading name, domain name, trade mark or industrial design; or
(c)a system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a system or process).
10.3You may not, without our prior written permission and the permission of any other relevant rights owners, broadcast, republish, upload to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Content or third-party content for any purpose. This does not apply to material on the Website that is freely available for re-use or in the public domain.
11.1Any personal information you provide to us through the Website or in connection with our Products and Services is handled in accordance with our Privacy Policy.
12.1Nothing in this clause 12 limits any guarantee, right or remedy under the Australian Consumer Law that cannot be excluded or limited.
12.2To the extent permitted by law, where Products or Services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, at our option, to:
(a)in the case of Products: replacing or repairing the Products, supplying equivalent Products, or paying the cost of doing so; and
(b)in the case of Services: supplying the Services again, or paying the cost of having the Services supplied again.
12.3To the extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or opportunity, except where that loss was a reasonably foreseeable consequence of our failure to comply with a consumer guarantee.
12.4We are not liable for any loss to the extent that it is caused by you, by third parties or by circumstances outside our reasonable control.
12.5To the extent permitted by law, we are not liable for any loss arising from your reliance on general information on the Website, or from the Website being unavailable or interrupted.
13.1You indemnify us against any loss, damage, cost or liability (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Website, except to the extent that it is caused or contributed to by us.
14.1Either party may end an engagement for Services by giving written notice to the other.
14.2If an engagement ends, you must pay for Services performed up to the date it ends, and for Products supplied or ordered for your project that cannot be cancelled or returned to the supplier.
14.3We may stop providing Services or suspend access to the Website if you breach these Terms.
15.1If a dispute arises out of or relates to these Terms, neither party may commence tribunal or court proceedings (except for urgent interlocutory relief) unless it has first complied with this clause 15.
15.2A party claiming a dispute has arisen must give the other party written notice setting out the nature of the dispute, the outcome sought and the action required to resolve it.
15.3On receipt of that notice, the parties must:
(a)within 14 days, try in good faith to resolve the dispute by negotiation or any other means they agree on;
(b)if the dispute is not resolved within 14 days of the notice, either agree on a mediator or ask the Resolution Institute to nominate one;
(c)share equally the mediator’s fees and the cost of the mediation venue, with each party paying its own costs of the mediation; and
(d)hold the mediation in Sydney, New South Wales.
15.4All communications made in connection with negotiating or mediating a dispute are confidential and, to the extent possible, are to be treated as “without prejudice” negotiations.
15.5If a dispute has not been resolved within one month of the mediation starting, either party may ask the mediator to end the mediation, and the mediator must do so.
16.1These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales.
17.1If any part of these Terms is found to be void or unenforceable, that part will be severed and the rest of these Terms will remain in force.
